More on the Vaccine Court
The National Vaccine Injury Compensation Program was created by Congress in 1986 when vaccine manufacturers threatened to stop making vaccinations due to legal risk in the standard tort court system.
It uses "Special Masters" as judges and has no jury.
It establishes a no-fault compensation (i.e. damages but not punitive) for persons allegedly suffering injury or death as a result of the administration of certain compulsory childhood vaccines.
Awards are funded by a $0.75 surcharge on each vaccine dose sold.
Proof of damages associated with the vaccine requires preponderance of evidence.
The vaccine court examined six cases and found that the MMR vaccine and the preservative thimerosal are not linked to autism (see link below).
Since its first case in 1988 up to 2018, the vaccine court has adjudicated more than 16,000 petitions and dismissed two-thirds of them. To the successful petitioners, and their lawyers, it has awarded about $3.6 billion [average of $675,000 each]. This amounts to "only" about one incident per million injections.
